    San Diego's Airbnb Regulations

    Areas Where Airbnb is Currently Allowed in San Diego

     

    The city has categorized permits into four different tiers:

    • Tier 1: Part-Time: This category refers to rentals booked for an aggregate of 20 days or less per year.
    • Tier 2: Home Sharing: This category refers to the rental of a room or rooms in the host’s primary residence for more than 20 days per year, with the host residing onsite.
    • Tier 3: Whole Home (excluding Mission Beach): It allows such home rentals where the entire house is rented out for more than 20 days per year and the host is not residing onsite.
    • Tier 4: Mission Beach Whole Home: It is specifically for the Mission Beach Community Planning Area and allows whole-home rentals for more than 20 days per year.  

    Permits for short-term rentals are available except for some residential zones are prohibited:

    • Accessory Dwelling Units (ADUs): Short-term rentals of ADUs are generally prohibited except for ones that were the permited companion units which existed before September 2017.
    • Affordable Housing Units: Short-term rentals are not allowed as a use for income-restricted affordable housing.

    How to Register an Airbnb in San Diego 

    Documentation that must be presented by the applicants includes:

    • Proof of Ownership or Authorization: The owner should provide documents proving that they have the right to operate a short-term rental at the given address.
    • Good Neighbor Policy Acknowledgment: A signed agreement which states that the applicant will abide by the city's Good Neighbor Policy, which is the one that sets the different types of expectations for community standards.
    • Transient Occupancy Tax (TOT) Certificate: The certificate thereof must prove that the registration for TOT collection and remittance has been acquired.
    • Timelines: The processing time for STRO license applications can differ. Submitting applications before the rental start date is the best practice to eliminate the possibility of any delays.

    Cost to Register an Airbnb in San Diego

    The tier structure determines the cost of application for the STRO licenses as follows:

    • Tier 1: $25
    • Tier 2: $100
    • Tier 3: $1,000
    • Tier 4: $1,000

    San Diego Hotel Occupancy Tax (HOT) Requirements

    All Airbnb owners need to collect and remit TOT which stands at 10.5% of the rental price.
